Programme Director: Prof.Mr. R. de Lange

The focal point of this research program is the significance of fundamental rights and human rights in legal systems characterised by complexities. Multiculturalism and pluriformity, globalisation, the interaction amongst national, European and international law, as well as the relationships between the various legislative and executive powers – on a national, supra-national and an international level- constitute the main axes of complexities each with its own influence on the implementation, enforcement and protection of fundamental rights.

The main issues of this research program are: the significance of fundamental rights in the multicultural and pluriform society; how the implementation of fundamental rights and their interplay is influenced by social developments leading to globalisation, multiculturalism and pluriformity; how the process of international norm development with regard to fundamental rights should be understood; what the significance of fundamental rights is for the formation of national, international and European institutions; which of the law-making bodies has the ultimate decision making power on determining the scope and efficacy of the fundamental rights. In this regard, is there an appropriate model to analyse the co-relation between the judiciary and the legislative power, both on a national as well as an international level?
